The amended information herein charged defendant with robbery in the first degree under the provisions of Section 560.120 (unless otherwise indicated all statutory references are to RSMo 1949, V.A.M.S.) and also charged two prior felony convictions. See Section 556.280, as amended Laws 1959, S.B. No. 117, Section 1, P.P. Vol. 40 V.A.M.S. In accordance with the provisions of the section last cited the trial court held a hearing outside the presence of the jury and found that defendant had been priorly convicted of two felonies and in each instance had been sentenced and imprisoned therefor. The subsequent jury trial resulted in a verdict finding the defendant guilty of robbery in the first degree. Thereafter, in compliance with Section 556.280(1), supra, the trial court proceeded to determine defendants punishment and such was fixed at imprisonment in the penitentiary for a term of twenty years. See Section 560.135. Defendant has duly appealed from the ensuing judgment and sentence.
